1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the website raiotechdigital.com (the "Site"), operated by Raiotech LLC, doing business as ("d/b/a") Raiotech Digital ("Raiotech," "we," "us," or "our"). By accessing or using the Site, or by submitting a form on or linked from the Site (including a Meta/Facebook or Google lead form), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. What These Terms Cover

These Terms govern your use of our public website only. Any paid engagement for marketing, web design, advertising, lead generation, CRM automation, AI, or other services is governed by a separate written services agreement between you and Raiotech. If there is any conflict between these Terms and a signed services agreement, the signed services agreement controls for that engagement.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • Introduce malware, scrape or harvest data through automated means without our consent, or interfere with the Site's normal operation;
  • Use the Site to transmit unsolicited advertising, spam, or fraudulent content;
  • Impersonate any person or misrepresent your affiliation with any person or entity.

We may suspend or terminate your access to the Site at any time, without notice, for conduct we believe violates these Terms or is otherwise harmful.

4. Intellectual Property

The Site and its contents — including text, graphics, logos, the "Raiotech" and "Raiotech Digital" names and marks, images, layout, and code — are owned by or licensed to Raiotech and are protected by intellectual property laws. You may view and use the Site for your own informational purposes. You may not copy, reproduce, republish, distribute, or create derivative works from the Site's content without our prior written permission, except as permitted by these Terms or applicable law.

5. Submissions and Communications

When you submit information through a form, email, phone, or text message, you represent that the information is accurate and that you have the right to provide it. Information you submit is handled in accordance with our Privacy Policy. Any ideas, suggestions, or feedback you send us about the Site or our Services are provided non-confidentially, and you grant us a perpetual, royalty-free right to use them without obligation to you.

6. Third-Party Links and Services

The Site may link to or integrate third-party websites and services (such as Meta, Google, scheduling tools, or payment providers) that we do not control. We are not responsible for the content, products, or practices of any third party. Your use of those services is subject to their own terms and policies.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is accurate, complete, or current. Any results, case studies, or testimonials described on the Site are not guarantees of future outcomes.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAIOTECH AND ITS OWNERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Raiotech and its owners, members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the changes on this page. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

12. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Raiotech regarding your use of the Site.

13. SMS / Text Messaging Terms

These terms apply if you opt in to receive text messages (SMS/MMS) from us:

  • Program. The Raiotech Digital messaging program sends informational and marketing text messages related to your inquiry, appointments, and our Services.
  • Consent. You receive texts only after you provide your mobile number and expressly opt in (for example, by checking an unchecked consent box on our form). Consent is not a condition of any purchase.
  • Eligibility. You must be 18 years of age or older to opt in to and receive text messages from us.
  • Message frequency. Message frequency varies based on your interaction with us.
  • Fees. Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt out. Reply STOP at any time to cancel. You will receive one confirmation message and then no further texts.
  • Rejoin. To resume messages after opting out, opt in again through our form or reply START.
  • Help. Reply HELP for assistance, or contact us using the details below.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • Privacy. Your information is handled in accordance with our Privacy Policy. We do not sell or share mobile opt-in data or consent with third parties or affiliates for marketing purposes.
  • Compliance. This messaging program is operated in accordance with applicable laws, including the Telephone Consumer Protection Act (TCPA), and with industry standards, including CTIA messaging guidelines.
